Submission Terms and Conditions

1. Introduction

These Submission Terms and Conditions ("Terms") govern the submission of any and all AI-generated or AI-assisted audiovisual content, including but not limited to films, shows, series, and related materials (collectively, "Content") by you, the filmmaker or rights holder ("Filmmaker," "you," "your"), to Streamlined ("Platform," "we," "us," "our"). By submitting Content to the Platform, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years of age or the age of majority in your jurisdiction to submit Content. If you are submitting on behalf of an organization or entity, you represent and warrant that you have the full legal authority to bind that entity to these Terms.

3. Content Ownership and Rights Granted

3.1. Your Ownership.

You retain all of your ownership rights in the Content you submit. Nothing in these Terms shall be deemed to transfer ownership of the Content from you to the Platform.

3.2. License to the Platform.

By submitting Content, you grant the Platform a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, perform, and otherwise exploit the Content in connection with the Platform's services. This includes, without limitation, promoting and redistributing part or all of the Platform (and derivative works thereof) in any media formats and through any media channels. This license is perpetual and irrevocable.

4. Filmmaker's Representations and Warranties

You represent and warrant that:

• You are the sole owner of the Content and/or have obtained all necessary licenses, rights, consents, and permissions to submit the Content and to grant the license set forth in these Terms.
• Your Content, and the Platform's use of it as permitted by these Terms, does not and will not infringe upon, violate, or misappropriate any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right.
• Your Content does not contain any material that is defamatory, libelous, obscene, pornographic, harassing, threatening, or otherwise unlawful or tortious.
• Your Content complies with all applicable laws and regulations.

5. AI-Generated Content Specifics

You further represent and warrant that:

• You have complied with the terms of service, licensing agreements, and usage policies of all AI tools, models, and platforms used in the creation of your Content.
• You have the right to use the output of such AI tools for the purposes granted herein, including commercial use on our Platform if applicable.
• You acknowledge the evolving and uncertain legal landscape surrounding intellectual property rights in AI-generated works and agree that you bear the risk associated with these uncertainties.

6. Indemnification

You agree to indemnify, defend, and hold harmless the Platform, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the submission process; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your Content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the Platform.

7. Content Review and Platform Discretion

The Platform has the sole and absolute discretion to accept or reject any Content submitted. We are under no obligation to host, display, or distribute your Content. We may remove any Content from the Platform at any time, for any reason or no reason, without prior notice. The submission of Content does not guarantee its inclusion on the Platform.

8. Limitation of Liability

IN NO EVENT SHALL THE PLATFORM, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF THE SUBMISSION PROCESS, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICES, OR (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN.

9. General

These Terms shall be governed by the laws of [Your State/Country], without respect to its conflict of laws principles. Any claim or dispute between you and the Platform that arises in whole or in part from the services shall be decided exclusively by a court of competent jurisdiction located in [Your City, County]. We reserve the right to amend these Terms at any time and without notice, and it is your responsibility to review these Terms for any changes.
